Terms & Conditions of Service

These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“Customer”) and Big Bully Networxs (“BBN”). By subscribing to or using our Services, you agree to comply with these Terms. If you do not agree, please refrain from using our Services.

  • Service Use: You agree to use the Services solely for lawful purposes, in compliance with all applicable laws and regulations. You may not engage in activities that harm, disrupt, or compromise the integrity of BBN’s network or the experience of other users.
  • Account Responsibility: You are solely responsible for the confidentiality of your account credentials and all activities under your account. Notify BBN immediately of any suspected unauthorised use.
  • Payment Terms: Monthly subscription fees are due in advance on the agreed billing date. Late payments may incur interest and service suspension. Reconnection fees apply where applicable.
  • Installation & Access: You consent to BBN and its contractors accessing your premises during normal business hours for installation, maintenance, upgrades, or recovery of equipment. You agree to provide safe and reasonable access.
  • Service Availability: While BBN strives for uninterrupted service, occasional outages may occur due to maintenance, upgrades, or circumstances beyond our control. We will take reasonable steps to minimise such disruptions.
  • Liability Limitation: BBN shall not be liable for any indirect, incidental, or consequential damages, including data loss, business interruption, or financial loss caused by service outages.
  • Cancellation & Termination: Services require a minimum of 30 days’ written notice for cancellation. Early termination fees may apply if you are within a fixed contract period. BBN reserves the right to terminate or suspend service for non-payment, abuse, or breach of these Terms.
  • Amendments: BBN may modify these Terms at any time. We will notify customers of significant changes in advance.

BBN is committed to protecting your personal information in compliance with the Protection of Personal Information Act (POPIA).

  • Data Collected: We collect personal details (such as name, contact info, ID number, billing information) to enable account setup, billing, service delivery, and support.

  • Use of Data: Data is processed only for purposes relevant to providing and improving Services. We do not sell or rent your data to third parties.

  • Data Sharing: Data may be shared with third parties strictly on a need-to-know basis (e.g., payment processors, fibre network operators) under strict confidentiality agreements.

  • Security Measures: We implement administrative, technical, and physical safeguards to protect your data from loss, misuse, and unauthorised access.

  • Data Subject Rights: You have the right to request access to, correction, or deletion of your personal data, and to object to certain processing.

  • Data Retention: We retain your data as long as required for operational, legal, or regulatory purposes.

BBN offers tiered SLAs depending on your package:

  • Uptime Commitment: 99.5% for standard business plans and 99.99% for enterprise packages, calculated monthly.

  • Support Response Times: Business support is available 24/7. Critical faults are acknowledged within 30 minutes and resolved within 4–6 hours for standard business; within 2–4 hours for enterprise clients.

  • Scheduled Maintenance: We conduct maintenance during off-peak hours and with at least 48 hours’ notice.

  • Performance Guarantees: Service credits are issued proportionally if BBN fails to meet uptime guarantees due to factors within its control.

  • Service Monitoring: Enterprise clients may request monthly performance reports.

When you subscribe, you agree to:

  • Grant BBN personnel reasonable access to your premises to install, maintain, upgrade, or recover our equipment.

  • Accept that the standard installation includes one access point unless otherwise specified. Additional internal cabling or extensions may incur additional fees.

  • Use all supplied equipment responsibly, ensuring it is not damaged, tampered with, or relocated without BBN’s consent. You may be charged for lost or damaged equipment.

  • Ensure your premises are ready for installation (power supply, accessibility, permissions where necessary).

  • Provide updated contact details if your address or phone number changes.

To maintain network performance for all customers:

  • Uncapped Services: Intended for standard residential or business use. Excessive use, such as continuous high-volume file sharing or server hosting on residential plans, may impact network performance.

  • Network Management: During congestion, we may prioritise traffic to ensure fair access for all users. Heavy users may experience throttling during peak hours.

  • Monitoring & Enforcement: BBN monitors usage trends and may contact users whose consumption is disproportionately high to recommend a more appropriate plan.

  • Breach Consequences: Repeat or malicious FUP violations may lead to service restrictions or termination.

BBN commits to full compliance with POPIA to safeguard customer privacy.

  • Governance: An Information Officer oversees compliance and training of all staff.

  • Transparency: Our privacy practices and data usage policies are accessible and updated regularly.

  • Security: We use encryption, access controls, and secure servers to protect customer data.

  • Data Subject Rights: Customers can request access, rectification, or deletion of their data, and can object to direct marketing.

  • Breach Reporting: Any breach of personal data will be reported to the Regulator and affected customers within statutory timelines.
